Panel Discussion - Data Retention

On the 16th March 2015, the historically first panel discussion took place on the premises of the Faculty of Law in Brno. We have chosen very extensive and interesting topic called Data Retention. This fast changing area of law is everywhere around us lately so it out of doubt deserves our attention. Modification of Data Retention can be regarded from different angles that’s why we have contacted many guests from various professional areas.

Invitations in the name of academia were accepted by JUDr. Matěj Myška, Ph.D and Mgr. Jakub Harašta. The telecommunication companies were represented by Mgr. Martin Cach from UPC Czech Republic, Ltd. and Radek Kučera from T-Mobile Czech Republic. We also had a representative from Criminal Police, mjr. Ing. Stanislav Kovárník.

Discussion was opened with a short interpretation of legal regulations – domestic and Union, which affect regulations of individual states. After short comparison with Austria and Netherlands all attendants realized how difficult this topic is.

All initial fears have disappeared thanks to very intriguing answers of our guests. Very interesting was an introduction to the practice of police tapping and its subsequent use in criminal proceedings, or an explanation of process of data holding and its subsequent destruction.

The discussion has concluded several questions from public, which were mainly focused on specific potential hazards data retention represents.
